Uninsured and untraced drivers
If you have suffered injury and financial loss as a result of an accident caused by an uninsured or untraced motorist, then you may still be entitled to compensation. It may be the case that you are the victim of an accident caused by a ‘hit and run’ driver. You may be either a pedestrian or motorist who was involved in an accident with either an uninsured driver or ‘hit and run’ driver.

This includes compensation for both the immediate injuries suffered and any long term consequences, together with financial losses.
Any company offering motor insurance in the UK must be a member of the Motor Insurers’ Bureau. The Motor Insurers’ Bureau will compensate victims of uninsured and untraced drivers in appropriate circumstances. The Motor Insurers’ Bureau is funded by all UK motor insurers.

Court proceedings must normally be commenced within three years of the date of your accident. If Court proceedings are not commenced within the three year period, then your claim will be out of time. Although a Court does have the discretion to allow Court proceedings to be commenced and to continue after the three year period has expired, this must not and cannot be relied on.
If the claim is as a result of an untraced driver, then the Motor Insurers’ Bureau will only consider your claim if your application is received within three years of the date of the accident for personal injury, or nine months in respect of property damage claims.
